Voucher Terms and Conditions
TERMS AND CONDITIONS OF GIFT VOUCHERS
I. Preliminary Information
These Terms and Conditions define the general conditions for issuing, the rules, and the manner of using Gift Vouchers.
II. Definitions
- Gift Voucher – a bearer voucher sold in the stationary Store and in the online Store, allowing the Holder to make payments for goods offered for sale in the stationary Store and online at www.colibra.eu.
- Purchaser – a natural person purchasing a Gift Voucher in the stationary Store or in the online Store.
- Holder – a person redeeming the Gift Voucher.
- Regulations – refers to these Terms and Conditions.
- Online Store – the website where goods and gift vouchers are offered for sale, operating at the domain www.colibra.eu.
- Stationary Store – a physical store where goods and gift vouchers are offered for sale. The Store is located at ul. Świerkowa 14 in Pruszków 05-800.
- Goods – products presented for sale in the stationary Store and through the online Store, which may be the subject of a transaction using the Gift Voucher.
- Issuer – refers to Colibra Polska Sp. z o.o. with its registered office in Łódź (90-350), ul. Ks. Bp. Wincentego Tymienieckiego 25c/221, Factory and Stationary Store in Pruszków (05-800), ul. Świerkowa 14, NIP: 5223201287, REGON: 388744777, KRS: 0000895650; email: colibra@colibra.eu.
III. General Conditions
- The Issuer offers for purchase in the stationary Store and in the online Store Gift Vouchers with a value of 100 zł, 200 zł, 300 zł, 400 zł, 500 zł (prices include 23% VAT). For each Gift Voucher, the Purchaser pays the appropriate nominal value of the Voucher.
- The values of the Gift Vouchers and their designs are published on the website www.colibra.eu.
- The Purchaser agrees to provide the Issuer with funds equal to the nominal value of the Gift Voucher.
- The Issuer commits to provide the Purchaser with the Gift Voucher and to accept payments made using the Gift Voucher for goods purchased by the Holder.
- The Gift Voucher may only be used to purchase goods in the Stationary Store and in the online Store.
- The Gift Voucher cannot be exchanged for cash (in whole or in part) and is non-refundable.
- The validity period of the Gift Voucher is 6 months from the date of its sale, according to the date on the Voucher document. Failure to use the Gift Voucher within the specified period results in loss of its validity and does not constitute grounds for claims by the Holder against the Issuer in this regard.
- The issuance of the Gift Voucher does not constitute a sale subject to value-added tax (VAT) as defined by applicable tax regulations. The sales document is issued at the time of purchase of goods.
- The rules and procedures for purchasing Gift Vouchers through the online Store are specified in the Online Store Regulations published on the website www.colibra.eu.
IV. Redemption of the Gift Voucher
- The Holder of the Gift Voucher has the right to redeem it under the following conditions:
- a. The Gift Voucher serves as a form of payment for goods purchased in the Stationary Store or in the online Store.
- b. The Holder of the Gift Voucher can use the amount indicated on the Gift Voucher for goods available in the offer in the Stationary Store and in the online Store www.colibra.eu.
- c. If the purchased goods are of lower value than the value of the Gift Voucher, the Holder is not entitled to receive a refund of the remaining, unused amount.
- d. If the purchased goods are of higher value than the value of the Gift Voucher, the Holder is required to pay the difference.
- e. The Gift Voucher has an expiration date, after which it loses its validity. The expiration date of the Gift Voucher does not change. After the expiration date, the Gift Voucher cannot be used for payments.
- f. The Issuer is not responsible for the loss or damage of the Gift Voucher by the Purchaser or Holder. In such cases, duplicates will not be issued.
- g. The Issuer reserves the right to refuse to issue goods in exchange for Gift Vouchers that are illegible, damaged, or otherwise raise doubts about their authenticity. In such cases, the Gift Voucher is considered invalid, without the right to receive a replacement Gift Voucher.
V. Complaints
All complaints related to the purchase of goods using the Gift Voucher will be processed by the Issuer in accordance with the complaint procedure specified in the Online Store Regulations available at www.colibra.eu.
VI. Final Provisions
- The Purchaser is obliged to inform the Holder about the terms of redemption of the Gift Voucher.
- The purchase of the Gift Voucher by the Purchaser and its presentation for redemption by the Holder is equivalent to acceptance of these Terms and Conditions by both the Purchaser and the Holder.
- The content of these Terms and Conditions is available in the Stationary Store and in the online Store at www.colibra.eu.
- In matters not regulated in these Terms and Conditions, the provisions of the Civil Code and other laws shall apply.
- The competent court for resolving disputes that may arise from the application of these Terms and Conditions is the common court competent for the Issuer's registered office.
- The Issuer reserves the right to change the Regulations at any time. Any changes shall take effect from the date of their introduction by the Issuer, after making the amended Regulations available for inspection in the Stationary Store and on the online Store's website and shall apply to Gift Vouchers purchased after the changes to the Regulations come into effect.
