- 1 DEFINITIONS
Consumer – consumer as defined in the Civil Code.
Newsletter – a free service provided electronically, through which the Service Recipient can receive from the Service Provider previously ordered messages regarding the Store, including information about offers, promotions, and new products in the Store.
Privileged Entrepreneur – a natural person who concludes an agreement with the Service Provider directly related to their business activity, but not having a professional nature for them (definition applicable to agreements concluded from January 1, 2021).
Store – Colibra online store - earrings, necklaces, rings, pendants, bracelets run by the Service Provider at https://colibra.eu
Service Recipient – any entity using the Newsletter service.
Privileged Service Recipient – Consumer or Privileged Entrepreneur.
Service Provider – COLIBRA POLSKA Sp. z o.o. with its registered office at ul. ks. Biskupa Wincentego Tymienieckiego 25c/221, 90-350 Łódź, entered into the National Court Register by the DISTRICT COURT FOR ŁÓDŹ-ŚRÓDMIEŚCIE IN ŁÓDŹ, XX COMMERCIAL DIVISION OF THE NATIONAL COURT REGISTER, under KRS number 0000895650, NIP 5223201287, REGON number 38874477700000.
- 2 NEWSLETTER
- The Service Recipient may voluntarily use the Newsletter service.
- To use the Newsletter service, a device with the latest version of an internet browser that supports JavaScript and cookies, with Internet access, and an active email account is required.
- Email messages within this service will be sent to the email address provided by the Service Recipient at the time of signing up for the Newsletter.
- To conclude an agreement and sign up for the Newsletter, the Service Recipient must first provide their email address in the designated place in the Store, where they wish to receive messages sent as part of the Newsletter. Upon subscribing to the Newsletter, an agreement for the provision of the service is concluded, and the Service Provider will start providing it to the Service Recipient, subject to paragraph 5.
- For the proper implementation of the Newsletter service, the Service Recipient must provide their correct email address.
- Emails sent as part of the Newsletter will include information about the option to unsubscribe, as well as a link to unsubscribe.
- The Service Recipient may unsubscribe from the Newsletter at any time without giving any reason or incurring any costs, using the option referred to in paragraph 6 or by sending a message to the Service Provider's email address: sklep@colibra.eu.
- Using the unsubscribe link or sending a message requesting to unsubscribe from the Newsletter will result in the immediate termination of the agreement for the provision of this service.
- 3 COMPLAINTS
- Complaints regarding the Newsletter should be reported to the Service Provider at the email address: sklep@colibra.eu.
- The Service Provider will respond to the complaint within 14 days of receiving the complaint.
ALTERNATIVE DISPUTE RESOLUTION METHODS - If the complaint procedure does not bring the expected result for the Service Recipient who is a Consumer, the Consumer may use, among others:
- mediation conducted by the competent Provincial Inspectorate of Trade Inspection, to which a mediation request should be submitted. As a rule, the procedure is free of charge. A list of Inspectorates is available here: https://www.uokik.gov.pl/wazne_adresy.php#faq595;
- assistance of the competent permanent consumer arbitration court operating at the Provincial Inspectorate of Trade Inspection, to which an application should be submitted to have the case heard before the arbitration court. - free assistance from the municipal or district Consumer Ombudsman;
- the online ODR platform available at: https://ec.europa.eu/consumers/odr/main/?event=main.home.howitworks.
- 4 PERSONAL DATA
- The Service Provider is the controller of the personal data provided by the Service Recipient in connection with subscribing to the Newsletter. Detailed information on the processing of personal data by the Service Provider – including other purposes and legal bases for data processing, as well as data recipients, is provided in the Store's Privacy Policy – in line with the principle of transparency included in the General Data Protection Regulation (GDPR).
- The purpose of processing the Service Recipient's data is to send the Newsletter. The legal basis for data processing in this case is the service agreement or actions taken at the Service Recipient's request prior to concluding such an agreement (Article 6(1)(b) GDPR), as well as the Service Provider's legitimate interest in processing data to establish, pursue, or defend any claims (Article 6(1)(f) GDPR).
- Providing data by the Service Recipient is voluntary, but necessary for the provision of the Newsletter service. Failure to provide data means that the Service Provider will not be able to provide this service.
- The Service Recipient's data will be processed until:
- The Service Recipient unsubscribes from the Newsletter;
- The possibility of pursuing claims related to the Newsletter by the Service Recipient or the Service Provider ceases;
- The Service Recipient's objection to the processing of their personal data is accepted – if the data processing was based on the Service Provider's legitimate interest
– depending on which occurs later and is applicable in a given case.
- The Service Recipient has the right to request:
- access to their personal data,
- rectification,
- deletion,
- restriction of processing,
- data portability to another controller
and also the right: - to object at any time to the processing of data for reasons related to the Service Recipient's particular situation – against the processing of their personal data based on Article 6(1)(f) GDPR (i.e., legitimate interests pursued by the controller).
- To exercise their rights, the Service Recipient should contact the Service Provider.
- If the Service Recipient believes that their data is being processed unlawfully, they may file a complaint with the President of the Office for Personal Data Protection.
- 5 FINAL PROVISIONS
- The Service Provider reserves the right to amend these terms only for important reasons. An important reason is considered to be the necessity to amend the terms due to modernization of the Newsletter service or a change in the law affecting the provision of the service by the Service Provider.
- Information about the planned amendment to the terms will be sent to the Service Recipient's email address provided at the time of signing up for the Newsletter at least 7 days before the changes take effect.
- If the Service Recipient does not object to the planned changes by the time they take effect, it is assumed that they accept them.
- If the Service Recipient does not accept the planned changes, they should send a message to the Service Provider's email address: sklep@colibra.eu, which will result in the termination of the service agreement upon the effective date of the planned change or earlier if requested by the Service Recipient.
- It is prohibited for the Service Recipient to provide unlawful content.
- The agreement for the provision of the Newsletter service is concluded in Polish.
- In the case of a Service Recipient who is not a Privileged Service Recipient, the competent court will be the court with jurisdiction over the Service Provider's registered office.
